Microsoft responds to Xbox Live bannings

Company says only a "small percentage" of Xbox 360 owners have been affected, mostly for modifying their consoles to play pirated games.
Mess around or play early: You get banhammered.
Reports of abnormally high bannings from Xbox Live have swelled on the internet in recent days, suggesting that Microsoft anti-piracy ninjas are inadvertently banning players again for gaining early access to hit games like Gears of War 2, which launched last Friday.
Without specifying how falsely banned Xbox Live members can get reinstated (customer service presumably can take care of it), Xbox Live evangelist Larry Hyrb announced on his blog: "In our our continued effort to keep gameplay safe and secure for our community of more than 14 million members, Microsoft has taken action against a small percentage of Xbox 360 consoles that have been illegally modified in order to play pirated games. You should know that modifying your Xbox 360 console is also a violation of the Xbox LIVE terms of use, will void your warranty and result in a ban from Xbox LIVE."
This isn't the first time owners of advance games have been banned from Xbox Live. In 2007, priveleged gamers with early access to Halo 3 cried foul after having their Xbox Live accounts accidentally banned as Microsoft took measures to stop dirty-rotten pirates.

This is BS. If you happen to get a LEGITIMATE copy of the game early that should be their problem. They need to come up with a better plan to stop pirating.

Obviously, it's BS. And obviously, if you get a legit copy earlier, you should be able to play without fear of banning. And yes, they need a better plan. Any ideas?

Too F*ckn bad for them. They knew they had a early copy of the game and decide to be the cool guy and log on to XBL to show off. The bad thing is that even though the bought a legit copy they broke the street date along with the thousands of pirated copies. So cry all you want, you knew you had a early copy and paid the price.

Damn, that is one way to do it... but how about a TEMPORARY ban... maybe a month? A permanent MAC address Ban is pretty harsh, forcing someone to buy another console. Both are bad, and the extreme should NOT be the default answer.

People should be smart enough to know the street date releases of new games. If they get one of these games early because 7/11 or K-Mart puts them out early don't play them especially if you use XBOX Live. I am 100% for banning pirates.

kubrick I'm sure they are going to cry and put the blame on the store clerk. Store clerks mess up all the time, sometimes its good: get an early copy of a game. Sometimes its bad: Getting over charged for items. These gamers knew they broke the street date, some even posted it on Youtube. Thats the price you pay for being the cool kid . Live with it.

this place down the street from me was selling Gears 2 2 days early--- if your stupid enough to go online with it then you get what you deserve.
it's TWO days man. waiting 2 days won't kill ya. I'm pretty sure they only can ban you if you play the game online, anyway the stores that sell the game early should be penalized as well. and now because of this crap they are going to stop shipping early so we are gonna have to go back to waiting for ups or fedex to bring the games in the late morning on the day of release.
